Privacy Policy

WrkPlan values and respects the privacy of those who visit WrkPlan.com and the pages of its site or use our WrkPlan software, products, and web-based services (the “Services”). This Privacy Policy addresses our privacy practices relating to visitors and users of our Sites and Services. It serves as notification regarding information collected automatically via the Sites or Services, as well as information affirmatively provided by Users.

If you do not want your Personal Data to be collected or processed as described in this Privacy Policy and in accordance with our privacy practices, you should not use the Sites. If you use our Services and have questions regarding the treatment of Personal Data, you should contact WrkPlan Support and consult the terms of your WrkPlan Service Agreement related to those Services.

“Personal Data” means any information that, by itself or in combination with other information, identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular natural person, including, based on applicable Privacy Laws, a consumer or household. While this Privacy Policy uses the term Personal Data, it shall be read to encompass similar terms such as Personal Information and Personally Identifiable Information, depending on jurisdiction. This does not include anonymized, aggregated, statistical, or non-personally identifiable data resulting from the use of the Sites and Services. “Privacy Laws” refers to applicable legislation, statutory instruments, and any other enforceable laws, codes, regulations, or guidelines regulating the collection, transfer, processing, use, and disclosure of, and/or rights to Users’ Personal Data based on their governing jurisdiction, including, in particular: (i) the California Consumer Privacy Act and its implementing regulations, as amended from time to time (the “CCPA”).

How We Use Personal Data

WrkPlan uses information about Users, including Personal Data, for a variety of purposes, including:

  1. To enable you to use our Sites or Services;
  2. To monitor usage and analyze statistical information related to our Sites or Services;
  3. To provide information regarding Services upon your request;
  4. To respond to your comments, questions, and requests;
  5. To fulfill our obligations and enforce rights arising from our contractual relationship with you;
  6. To improve and maintain the security, performance, and operational efficiency of our Sites or Services;
  7. To provide customer support;
  8. To send communications regarding Services or related information; and/or
  9. For any other purpose with your consent.

When you visit the Sites, WrkPlan may collect a limited amount of Personal Data based on your internet connection.

The categories and extent of Personal Data customers choose to collect and store in their WrkPlan system databases are largely at the customer’s discretion and may vary depending on the Services provided, scope of engagement, and any configurations or customizations. Customers should contact WrkPlan Support for more information.

a. Data Integrity

You are responsible for the accuracy of the information you provide to WrkPlan. We will use reasonable efforts to maintain the accuracy and integrity of such information and update it as appropriate. WrkPlan will not retain data longer than necessary without your consent, unless required by law.

b. End-User Personal Data

As part of using the Services, you may enable access to your end-users (as governed by your Services Agreement). WrkPlan processes Personal Data on behalf of customers and has no direct relationship with end-users. You are responsible for ensuring compliance with applicable Privacy Laws. The respective obligations of customers and WrkPlan are outlined in your Services Agreement.

c. Automated Collection

WrkPlan collects log files, domain names, and IP addresses for statistical purposes, performance monitoring, and customization. This data helps improve user experience and system performance. Access is restricted to authorized personnel and may be disclosed only for security, legal, or contractual enforcement purposes.

Most web browsers allow control over cookies. You may choose to block or delete cookies; however, some features of the Sites or Services may not function properly without them.

d. Processing of Personal Data

WrkPlan’s legal basis for processing Personal Data depends on the context, including consent, contractual necessity, legitimate interests, or legal obligations.

e. WrkPlan may process Personal Data to comply with legal obligations or to establish, exercise, or defend legal claims.

f. Customer-entered data (e.g., employee or business data) is used only for providing Services and support as requested.

g. Where required, WrkPlan will clearly indicate whether providing Personal Data is mandatory and the consequences of not doing so.

Confidentiality and Security of Personal Data

WrkPlan takes commercially reasonable steps to protect Personal Data from loss, misuse, or unauthorized access. However, no method of transmission over the internet is completely secure. Users are responsible for safeguarding access credentials.

We maintain procedures to address potential data breaches and notify relevant authorities and affected individuals where required.

Face Recognition Data

Collection of face recognition data is optional for customer organizations. WrkPlan uses this data only for user authentication and deletes it when employee status is terminated.

Disclosure / Onward Transfer of Personal Data

Personal Data is used solely for business purposes and shared only when necessary or legally required. Third parties supporting WrkPlan Services are contractually restricted from using or disclosing Personal Data beyond their scope.

Business partners operate independently, and any additional services are governed directly between you and the partner.

User Rights to Personal Data

Depending on applicable Privacy Laws, users may request access, correction, deletion, restriction, or transfer of Personal Data. These rights are subject to legal limitations.

The CCPA allows California consumers to request disclosure of Personal Data usage over the past 12 months. WrkPlan will verify identity before responding.

a. Marketing

You may opt in or out of marketing communications at any time using provided options.

b. Selling of Personal Data

WrkPlan does not sell Personal Data as defined under applicable laws.

c. Consent

You may withdraw consent at any time without affecting prior lawful processing.

d. Concerns

Users may submit inquiries regarding Personal Data processing through WrkPlan Support.

e. Non-Discrimination

WrkPlan does not discriminate against users for exercising privacy rights.

Privacy Policy Changes

This Privacy Policy may be updated periodically. Changes will apply only to data collected after the updated effective date unless otherwise stated.
